Last week, the Michigan Court of Appeals found a Michigan terrorism threat statute, MCL 750.543m, “facially unconstitutional.”
Our firm had just taken a case where our client was charged with that exact crime. The next day, our firm filed a motion to dismiss on the basis that the offense was unconstitutional.
In response, the charges against our client were amended—instead of a 20-year felony, the charge was reduced to a 6-month misdemeanor.
